Is the Lead Base Paint Disclosure in your Lease?

paint-300x200Lead is a metal that was seen as highly useful part of many chemical processes and was extensively used in manufacturing industries till about the mid 1970’s. Lead turned out to be highly toxic, and because of it’s makeup, readily gets absorbed into the body. Lead poisoning is connected to a number of health problems of the heart, liver, lungs and even the kidneys. In young children lead has shown itself to cause behavioral and cognitive problems. In the year 1978, all lead based paint was banned in the USA.

If you have a house or a property that was constructed before 1978, there are chances that the walls have some form of lead based paint on them. Even if, over the years, layers of paint have been added to them, the underlying base may still be laced with lead. Over the years, the paint may dry out and chip or crack, throwing out leaden dust into the air that the tenants may end up breathing. The EPA and HUD have made it mandatory for every landlord to have a lead based paint disclosure as part of their lease documents.

When does this apply to you?

All landlords, especially those who have residential properties are required to have a lead based paint disclosure done before taking tenants in. It is all the more necessary that this be done if the building was built before 1978. If you are not sure about the type of paint that was used when the building was constructed, you can have it checked. Also, you can attach lead safety pamphlets to your agreement documents.
